TERMS & CONDITIONS

 

1. General: 

1.1. All references to “we” and “us” in the following terms and conditions refer to Cream-Crackers UN operating from www.cream-crackers.com

1.2. You must be aged 18 years or over to purchase any of our products. By placing an order you confirm you are at least 18 years old. 

1.3. All items for sale are brand new unless otherwise stated. 

1.5. Dispatch of items 

1.5.1. Royal Mail: We endeavour to dispatch items within 24 hours of receipt of cleared payment, except during weekends and UK bank holidays. However on most weekdays, items will be despatched the same day if cleared payment is received before 1300 hrs. This is also dependant on all items for an order being in stock. 


2. Payment: 

2.1. We accept UK postal orders, UK cheques, UK currency and all forms of PayPal payments. We will wait until payments are cleared, where relevant, before issuing items. Please note that, in our experience, PayPal eCheques normally take 10 days to clear. We strongly suggest that if sending cash, you obtain a suitable level of compensation for loss – see Royal Mail Website for details. 

2.2. Payments should be made within 7 working days from the purchase date. If you are not using PayPal as your payment method, please include with your payment, the description and colour of item(s), (if applicable). 

3. Returns 


3.1. Contract Cancellation: If you are purchasing from within the European Union, you have the right to cancel the contract for the purchase of any items within a period of 7 working days, beginning with the day after the day on which the item is delivered. 

3.1.1. If you wish to return item(s) under the terms of 3.1 above, then the items must be unused, in their original packaging, with all relevant seals attached and unbroken. The item(s) must be sent to us so that we receive them within 7 working days after the day of the date that the item(s) were delivered to you. For your protection, we recommend that you use a recorded-delivery service. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is damaged on receipt, (see 3.2 below). 

3.2. Wrong/Damaged items: 

3.2.1. Wrong item(s): If we send a wrong item or items to the buyer, then they can be returned for replacement or refund at the buyer’s discretion. We will refund the postage costs associated with the return of the item(s). The buyer must contact us with details of the item(s) received BEFORE returning the items to us. Any items to be returned to us must comply with the item condition description given in 3.1.1 above. 

3.2.2. Damaged item(s): We take great care in the packaging of all our items, but in the unlikely event the buyer receives item(s) damaged in transit, we will replace the item(s) at no further cost to the buyer. The damaged item(s), and all associated packaging, will have to be returned to us before we issue the replacements. The postage cost associated with the return will also be refunded by us. Please contact us BEFORE returning the item(s) to discuss the method of return. If it is impractical to return the damaged item(s), then we would require photographic evidence of the damage to be forwarded to us before we issue replacements. 

4. Proof of Posting/Postal issues: 

4.1. A proof of posting is obtained for all packages sent. 

4.2. For packages deemed lost in the Royal Mail postal system, we will be happy, on behalf of our customers, to complete the relevant forms for the Royal Mail investigation into the loss. Please note, however, these investigations can take a considerable time to be completed. 4.3. Shipping is only free to customers based in the UK mainland. You will be asked to pay extra if you order from overseas (Canisters only) - Crackers are shipped for free Worldwide. 

5. Disclaimer of liability: 

5.1 All references to “we" or "our" in all statements under this paragraph 5 of the terms and conditions refer to Balloon Crackers UK. All references to “website” in all statements under this paragraph 5 of the terms and conditions refer to www.cream-crackers.com

5.2 Neither Cream-Crackers nor any of our employees, make any warranty, express or implied, including the warranties of merchantability and fitness for a particular purpose, or assumes any legal liability or responsibility for the accuracy, completeness, or usefulness of any information, apparatus, product, or process disclosed. 

5.3 The information contained in this website is for general information purposes only. The information is provided by Cream-Crackers and whilst we endeavour to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk. 

5.4 In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, in connection with the use of this website, or the information, products, services, contained on the website. 

5.5 Cream-Crackers will not be liable whatsoever for any injury or death resulting from the use of the information, products, and services contained on the website.

5.6 Every effort is made to keep the website up and running smoothly. However, Balloon Crackers UK takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control. 

6. Other: 

6.1 Nitrous Canisters - Product Overview: 

Filled with pure N2O gas in a factory which is ISO 9001, NSF/ANSI 18 Certificated, and German TÜV-Mark Certified. 
-These chargers are nickel-coated so that any 'moisture' doesn't cause rust on the top of the charger, and also gives a shiny-clean finish. 
- Universal (standard 8g screw-in system) fitting - not for Push-Valve (Kisag) system or new 16g system. 
- Filled with pure N2O gas in a state of the art factory. 
- Each charger is weighed electronically with filling guarantee. 
- Will turn 1/2 litre of whipping cream into up to 1.5litres of whipped cream! Far greater a volume than mechanical whipping. 
OVER 18's ONLy: This product is not for sale to under 18's. 
Resellers please ensure your customers are over 18.

IMPORTANT SAFETY DATA: 
Cartridge contains 8g of Nitrous Oxide UN1070 (E942) under high pressure. 
Please only use with a device approved for this cartridge and follow manufacturers instructions. 
Non-aerosol. Non refillable. Recyclable steel. 
Never dispose of full cartridges. 
Keep out of reach of children. 
Explosion danger - 50C max temperature. 
Do not take onboard an aircraft.

For food use only. 

RECYCLING: Gas cartridges are not refillable. They are made with 100% recyclable steel. They are safe to put in with your tin cans etc for collection. Please do not dispose of unused cartridges!
